Terms of service
These terms cover everything on this site and every programme sold through it: MERGE60, DadBody 28, The Power 30, the member portal and the written and audio material.
Who you are contracting with
DadBody is the coaching brand of MERGE Fitness Inc, a company registered in British Columbia, Canada, trading as DadBody by Dai Manuel. When you buy a programme or use this site, your agreement is with MERGE Fitness Inc.
Questions go to Dai directly through the contact page.
Accepting these terms
By using this site, applying for a programme, or buying anything here, you agree to these terms. If you do not agree with them, do not use the site.
You confirm you are of legal age in your country, and that if you are signing up on behalf of an organisation you have the authority to do so. Everything you tell us must be accurate and kept up to date.
Orders and payment
Programmes are sold by MERGE Fitness Inc. We handle orders, invoicing, customer service and returns ourselves.
Prices are agreed and confirmed in writing before you pay. Programmes are one-off purchases: no auto-renewal, and we do not keep your card details on file.
Our own refund commitment is set out on the refund policy page.
What you get, and what we do not promise
A programme gives you a limited, personal, non-exclusive, non-transferable right to take part in it and to use the material for your own training. Places are personal and cannot be sold, given away or transferred to another person.
We do not guarantee the site, the member portal or any third-party tool we use (including the training app) will be uninterrupted, error free or available at all times. To the fullest extent the law allows, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.
Coaching is not medical care. Dai Manuel is a coach, not a doctor, and nothing here is medical advice, diagnosis or treatment. Clear training with your doctor if you have a condition, an injury, or you take medication. You train at your own risk.
How you must not use it
You must not:
- use the site or any programme unlawfully, or for fraud or spam;
- infringe anyone's intellectual property, or share, resell or republish our material;
- interfere with the security of the site: no malware, no probing, no scraping, no attempts to get around access limits or paywalls;
- share your login, or let anyone else use your place in a cohort;
- repeat anything said by another man in a group call or group chat outside that group.
You are responsible for keeping your account details confidential and for everything done under your account.
Ownership
MERGE Fitness Inc owns the site, the programmes, the written and recorded material, the worksheets, the branding and the name DadBody. Nothing you buy transfers ownership of any of it. Reverse engineering, redistribution and resale are not permitted.
Anything you write or upload stays yours. You grant us a limited licence to store and process it only so we can coach you and run the service.
Suspension and ending access
We can suspend or end your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious misuse, including abusive behaviour toward Dai or another member of a cohort.
You can stop using the service at any time. When access ends you keep any results pack already issued to you; your account data is handled as described in the privacy notice.
Liability
To the extent the law allows, MERGE Fitness Inc is not liable for indirect or consequential loss, including lost profits, lost data or lost goodwill, and total liability is capped at what you paid us in the twelve months before the claim.
Nothing here excludes liability for fraud, or for death or personal injury caused by negligence, where the law does not allow it to be excluded.
You agree to cover us for claims arising from your unlawful use of the service or your breach of these terms.
Law and changes
These terms are governed by the laws of British Columbia, Canada, and the courts of British Columbia have jurisdiction. If we update these terms, the date below changes and the current version always applies to new orders.
Programme-specific rules sit alongside these terms. For MERGE60, see the MERGE60 programme terms. Where a programme term conflicts with these terms, the programme term applies to that programme.
